Jurisdiction - Foreclosure Auction Sales (Proclamation 97/90): While Proclamation 97/90 grants banks specific powers to conduct foreclosure auctions, it does not entirely remove such sales from the purview of regular courts. Regular courts retain jurisdiction to hear cases challenging the legality of the sale itself when allegations are made that the bank's actions in conducting the sale were illegal, improper, or violated the borrower's rights, as opposed to mere procedural challenges to the auction process. The Cassation Division clarified the distinction between challenges to the process and challenges to the legality of the sale, with the latter falling within the jurisdiction of regular courts. A regular court can't interfere with the process of the auction under the proclamation but can examine the legality of the bank's actions leading to the sale.
